Law Firm Prevails Over Internal Revenue Service
On Claim To Litigation Referral Fee
Kleinbard lawyers Robert Bodzin and Paul Gagne were victorious in a recent Federal Court trial to determine whether a litigation referral fee of approximately $1 million dollars was the property of a law firm partnership or was subject to the lien of the Internal Revenue Service to satisfy the tax liabilities of a departed partner of the law firm. The Federal District Court Judge found that even though the law firm had failed to file partnership returns and that there was no written partnership agreement, the law firm otherwise operated in the manner of a partnership and was thus entitled to the referral fee. |
