Employment
Law
Our attorneys have defended employers in gender, age, race,
and disability discrimination cases brought under both federal
and state laws, and before federal courts, state courts and
administrative agencies. Our attorneys have also successfully
defended claims through defense verdicts and affirmance on
appeal, and have secured settlements for amounts less than
the cost of defense. We have litigated wage payment and collection
claims and defended several wage and hour audits conducted
by the Department of Labor. We have secured injunctions enforcing
restrictive covenants and winning money damages from our clients'
competitors, and have successfully prevented their enforcement,
as well.
We counsel employers on employee terminations, disciplinary
actions, substance abuse policies, wage and hour compliance,
and benefits. We have conducted seminars on sexual harassment
and provided advice on employee handbooks and personnel policy
manuals. We regularly advise employers on compliance with
Title VII, ADA, ADEA, FMLA, and WARN Act. We have also handled
traditional labor-management and workplace health/safety matters.
Our employment law clients include employers in manufacturing,
retail, services, automotive, distribution, telecommunications,
education and health care businesses.
We also represent executives in a broad range of industries
in their employment severance disputes, and have repeatedly
negotiated valuable severance agreements for our clients without
resorting to litigation. When litigation was required, we
have secured favorable results. In 1998, we obtained a seven-figure
settlement for a former drug company executive. In 1999, we
served as co-counsel to an executive who won a jury award
of $10.5 million for a fraud-in-hiring claim, and we won an
arbitration award of over $800,000 for a publishing executive
following his employment termination and undervaluation by
his employer of his phantom stock.
