Estate and Construction Litigation
We represent developers, manufacturers, and lenders in a variety
of real estate and construction litigation matters. For example,
we have represented a shopping center developer and its affiliated
general contractor in a number of state court and federal
actions arising from the dissolution of limited real estate
partnerships and involving claims for RICO violations, breach
of fiduciary duty, breach of employment contracts, and bank
fraud. In the course of this continuing litigation, we defeated
efforts to have a receiver appointed, succeeded in having
reaffirmed our clients' rights as general partner and property
manager, and secured payments to the affiliated general contractor
of $100,000 for disputed construction claims. We have represented
developers and landowners in lease termination injunction
proceedings, actions to quit title, and breach of contract
claims. We have also represented a bank holding company in
fraud, fraudulent conveyance and contract actions where the
claims exceeded $80 million.
In the construction litigation area, we recently defended
a national manufacturer in a $3 million construction dispute
over a water filter system built for the city of Las Vegas.
We have also prosecuted claims for a general contractor against
subcontractors for property damage to construction sites,
represented a computer cable installer in a dispute with a
local school district, and defended claims for defective goods
against material suppliers.
